ENTIRE AGREEMENT: This agreement contains the entire understanding between Janet
Winslow, Winslow’s Pix and the CLIENT. It supersedes all prior and simultaneous
agreements between the parties. The only way to add or change this agreement is
to do so in writing, signed by all the parties. If the parties want to waive one
provision of this agreement, that does not mean that any other provision is also
waived. The party against whom a waiver is sought to be effective must have
signed a waiver in writing.
RESERVATION: A signed contract after payment of the reservation fee (SAVE THE DATE)
must be signed for my files within 30 days of your reservation fee.
PRE-EVENT CONSULTATION: The parties agree to a pre-event consultation which
can be by phone, but personally would be better - before the
event date in order to finalize the actual shooting times, locations, and
deliver the CLIENT'S request list (in writing) for specific photographs to
Winslow’s Photography.
The client will be responsible for, or have someone designated, to identify
people of whom specific photographs are desired. The photographer will not be
held accountable for not photographing desired people from the list if there is
no one to assist in identifying people or gathering people for photograph's, or
the desired people are off doing errands, projects, or other tasks which
preclude them from being found and available to be included in photographs.
The bride and or groom agree to set aside enough time before to complete all
requested pre-wedding ceremony photographs 1 hour prior the start of the
wedding. Allocate 3 minutes per requested individual or group photo as a time
guide. At least 30 minutes of time must also be planned after the wedding
ceremony to gather people for photographs that could not be obtained during or
before the wedding. If the bride's or groom's late arrival, or other people,
prevents all the desired images from being taken the photographer shall not be
held liable for lack of time to take desired photographs. Your picture package
also contains photos made at your rehearsal should you desire them. They will be
included at the end of the wedding DVD.
COOPERATION: The parties agree to cheerful cooperation and communication for the
best possible result within the definition of this assignment. Janet Winslow/
Photography is not responsible if key individuals failure to appear or cooperate
during photography sessions or for missed images,
SHOOTING TIME / ADDITIONS: The photography schedule and selected methodology are
designed to accomplish the goals and wishes of the CLIENT in a manner enjoyed by
all parties. CLIENT and Janet Winslow Photography agree that cheerful
cooperation and punctuality are therefore essential to that purpose. Shooting
commences at the scheduled start time.
HOUSE RULES: The photographer is limited by the guidelines of ceremony official
or reception site management. CLIENT agrees to accept the technical results of
their imposition on the photographer. Negotiation with the officials for
moderation of guidelines is CLIENT'S responsibility; Janet Winslow, Winslow’s
Pix will offer technical recommendations only. We really like it when the
minister will allow part of our team access during the actual wedding up front.
He likes to stand in behind the groomsmen insuring some fantastic frontal shots
during the actual ceremony.
START / STOP TIMES: The photographers will photograph your rehearsal the night
before the wedding, if desired. The photographer will be at the place of the
wedding one hour prior to the wedding (UNLESS THERE ARE EXTRA STIPULATIONS, SUCH
AS EARLY SET UP FOR PICTURES), and throughout the entire reception.
Remember to schedule time for your after wedding pictures, cutting the cake and
toasting pictures, garters and bridal bouquet throw pictures!
PICTURES and COPYRIGHTS: ALL photographs produced by Janet Winslow, Winslow’s
Pix are protected by Federal Copyright Law (all rights reserved) and may not be
reproduced in any manner without Janet Winslow, winslowspix.net's explicitly
written permission. The CLIENT will have limited copyright ownership of the
resulting images allowed to the CLIENT under the following conditions:
The pictures are for the CLIENT’S personal use and for the purposes of the
reproduction and giving of photographs to friends and relatives.
Images may be used on personal web sites as long as a copyright notice appears
near the images stating that they were taken by Janet Winslow, Winslow’s Pix.
QUANTITY OF IMAGES TAKEN AND TAKING OF SIMILAR IMAGES: In order to ensure that
the pictures desired by the couple is recorded and preserved for them, and to
lessen the possibility of equipment or photographer error, there are some poses
and group shots that will be taken multiple times and or with multiple cameras.
This is done to ensure that if a person blinks, distractions in the background
which are not initially seen, hair, clothes or equipment (camera, flash, or some
other item) fails to work as expected another image using the same or different
camera has also recorded a similar image onto film. This means that there will
be multiple similar images delivered to the client.
Group photos will require more images be taken so as to ensure that a great
image is captured.
Multiple cameras. When photographs are taken with multiple different cameras,
each one will have a different type of lens on it. This results in slight
perspective changes (wide angle on one camera, standard lens, or a telephoto
lens on a camera) and thus also more variety to choose from and those will all
be included on your CDROM as well.
EXHIBITION: Requests for duplicates may be asked by Janet Winslow, Winslow’s Pix
at a future time. CLIENT grants Janet Winslow, Winslow’s Pix permission to
display selected images resulting from this assignment as an example of Janet
Winslow, Winslow’s Pix work and for entrance into photographic competitions and
release all claims to profits that may arise from use of images.
MODEL RELEASE. The CLIENT hereby grants to Janet Winslow, Winslow’s Pix and its
legal representatives and assigns, the irrevocable and unrestricted right to use
and publish photographs of the CLIENT or in which the CLIENT may be included,
for editorial, trade, advertising and any other purpose and in any manner and
medium; to alter the same without restriction; and to copyright the same. The
CLIENT hereby releases Janet Winslow, Winslow’s Pix and its legal
representatives and assigns from all claims and liability relating to said
photographs.
LIMIT OF LIABILITY: In the unlikely event that the photographer is injured or
becomes too ill to photograph the event, Janet Winslow, Winslow’s Pix will make
every effort to secure a replacement photographer. If the situation should occur
and a suitable replacement is not found, responsibility and liability is limited
to the return of all payments received for the event package. Janet Winslow,
Winslow’s Pix takes the utmost care with respect to exposure, transportation,
and processing the photographs. However, in the unlikely event that photographs
have been lost, stolen, or destroyed for reasons within or beyond Janet Winslow,
Winslow’s Pix's control, Janet Winslow, Winslow’s Pix liability is limited to
the return of all payments received for the event package. The limit of
liability for a partial loss of originals shall be a prorated amount of the
exposures lost based on the percentage of total number of originals.
SAVE THE DATE FEE: In the event of cancellation, the save the date fee is
non-refundable.
CHANGE OF DATES: If after a contract is signed the CLIENT changes the wedding
date there will be no charge to move to the new date if there is no scheduling
conflict.
PAYMENTS: CLIENT agrees to timely payments and full payment made no later than
two weeks prior to the wedding. If there is no payment, no pictures will be
taken.
A PayPal link can be sent to you for your deposit OR YOU MAY PAY AT THE WEBSITE
(www.winslowspix.com).
If you would like the sample DVD 4 TV, you may pay online for that, or just call
me. IF YOU HAVE BEEN REFERRED BY WEDPLAN, YOU WILL RECEIVE
YOUR SAMPLE DVD AT NO EXTRA CHARGE. IF YOU HAVE PAID FOR THE DVD, I WILL
REIMBURSE YOU.
Terms
PROCESSING - your CDROM full of pictures will be finished
approximately one (1) weeks after event unless otherwise advised. In case
of additional bookings, you may receive your 6 copies of DVD4TV after 10 to 14
days. If for some reason you hate the music I use, please let me know, I
will change it for you free of charge (one time) and give you all new DVD's.
Wedding Flat Fee rate is $600.00 .
$50.00 Save the date fee must be paid and is (non refundable). I will send you a
free video IF you have saved your date. I do need a signed copy of your contract
within 30 days of your deposit payment.
Full payment of $600 is due no later than two weeks before the wedding. No
payment - no pictures - no exceptions!
